Could a Fatal Motorcycle Accident Be Prevented With a Helmet?

A fatal motorcycle accident took place on U.S. Highway 30. The driver of a pickup truck driving westbound struck a motorcycle attempting to turn left onto Southwest 2Avenue. As a result, the driver of the motorcycle died at the scene. The motorcyclist was not wearing a helmet at the time of the motorcycle accident. U.S. Highway 30 was blocked for about three hours while the scene of the accident was cleared. In the meantime, the Idaho State Police is still investigating this fatal motorcycle accident.

State Helmet Laws

The question will always remain; would the motorcyclist be alive if they wore a helmet? There is no way to correctly make such a claim. Arguably, a helmet is made to protect. However, there is a longstanding debate on whether a helmet should be required by law.

Moreover, only 20 states in the U.S. require all motorcyclists to wear a helmet while riding. Most other states are like Idaho in that if the motorcyclist is under 18 they must wear a helmet. Iowa and Illinois are the only two states to leave the decision completely up to the motorcyclist.

Could a Helmet Prevent a Fatality?

Different helmets protect your head differently. Speed and the nature of the motorcycle accident are major factors of whether the helmet will be able to protect in an accident. Some may argue a helmet cannot protect your whole body so why should a motorcyclist be required to wear one? Others may also say a helmet adds greater risk to the driver because cars around them will falsely believe the rider is protected and follow more closely. A major reason people claim to not wear a helmet is if they hit their head it would cause swelling. The swelling would then knock the motorcyclist unconscious if wearing a helmet.

We can all agree that a motorcyclist needs to be extra cautious while driving since they are not as protected as a driver in a vehicle. If you have sustained injuries from a motorcycle accident and would like Parke Gordon to review your case, please call us at 208-322-7274.
